GENERAL PROVISIONS 1.1. The Organizer of the “GRAB AN ELECTRIC BIKE“ promotion, hereinafter referred to as the “Promotion”, is Master-Sport Automobiltechnik (MS) Production-Distribution Center Wiesław Rutka, 11 Listopada 68, 380-300 Gorlice entered into the Register of Entrepreneurs of the Central Business Register under NIP 738-000-39-64, hereinafter referred to as the „Organizer“.1.2. The organizer is promising a reward within the meaning of art. 919 of the Civil Code.1.3. The promotion is organized in the period from 23.05.2018. until 30.06.2018.1.4. The promotion is conducted on EU territory.1.5. The goal of the Promotion is to promote the Organizer and his products, increase sales of these products and build the brand awareness of the Organizer with the final recipients.1.6. The Organizer’s intention is not to obstruct access to the market for other entities (hereinafter: „Other Entities“) offering the sale of products corresponding generically to the products covered by the Promotion, in particular the conditions of participation in the Promotion and conditions for winning prizes are in no way dependent on the number of other Entities‘ products to be ordered by the Promotion Participant, both during the Promotion and after it’s completion.1.7. The promotion covered by these regulations is not a „game of chance“, including in particular a „money lottery“, a „promotional lottery“, or a „raffle“, the result of which depends on chance (drawing) within the meaning of art. 2 of the Act of November 19, 2009 on Gambling Games (Journal of Laws 09.201.1540). II. CONDITIONS OF PARTICIPATION IN THE PROMOTION 2.1. Each entity cooperating with the Organizer and purchasing products covered by the Promotion may become a Participant of the Promotion (hereinafter referred to as „Participants“).2.2. The condition of participating in the Promotion is to accept the terms of the Regulations, give consent to the processing of the Participant’s personal data and confirm the fulfillment of other conditions entitling to participate in the Promotion, which the Participant confirms by joining the Promotion.2.3. Participation in the Promotion is voluntary; taking part in the Promotion is tantamount to the acceptance of the Promotion rules contained in the Regulations.2.4. The promotion covers the following products of the Organizer’s brand;2.4.1 70 Swingarm sets (KITs)2.4.2 52 Cabin filters ANTI-SMOG/STOP-MICROBE2.4.3 32 Lithium-ion batteries (LiFeP4) according to the list (link), hereinafter referred to as „Products“.2.5. The promotion consists in that the Participants who purchase during the promotion the Products covered by the Promotion for the amount of EURO 10,000 net, including:2.5.1. At least 1 set of 70 swingarm KITs;2.5.2. At least 3 pieces of each type of 52 cabin filters ANTI-SMOG/STOP-MICROBE; will receive an award from the Organizer.2.6. The prizes shall be awarded to the Participants on the basis of the cumulative value of the turnover made with the Promotional Products during the promotion. Purchases made by Customers with more than one branch are summed up based on the payer’s account/NIP number.2.7. The Promotion shall cover orders paid before the day of its settlement.2.8. Awarding the prize in the Promotion requires the lack of overdue obligations to the Organizer. In the case of a Participant who has a past due payment to the Organizer, such Participant is not considered in the settlement of results.2.9. Products covered by the promotion are not refundable or exchangeable.2.10. The Promotion prizes include electric bikes by BavarianStrongBikes, model „Sport Vintage“ (black/cream color) with the value of EURO 1,200.2.11. The Organizer shall verify the Participant’s right to the prize based on the sales and payment statement made by the Participant referred to in items 2.5. through 2.8.2.12. The prizes will be handed over to the Participants by the Organizer’s Sales Representatives, by courier or will be handed over personally at the Organizer’s office within 30 days from ending the Promotion and the Organizer’s settlement as referred to in item 2.9.2.13. The winner confirms the receipt of the prize with their own signature on the receipt confirmation. In case of the prize not being collected, refusal to collect it or refusal to confirm its receipt, the prize is forfeited and remains at the Organizer’s discretion.2.14. The prizes shall be issued to the Participants in accordance with the applicable tax regulations.2.15. Prizes are not exchangeable for cash or other types of prizes.2.16. The participant may not transfer the right to receive the prize to third parties. III. COMPLAINT PROCEDURE 3.1. Complaints as to the course of the Promotion may be submitted in writing to the Organizer’s address: Master-Sport Automobiltechnik (MS) Production-Distribution Center Wiesław Rutka, 11 Listopada 68, 380-300 Gorlice, no later than within 60 days from the end of the Promotion. The deadline for submitting complaints is determined by the date of the complaint reaching at the above address.3.2. The right to submit a complaint is only available to the Promotion Participants.3.3. A written complaint should include the Participant’s name and surname, exact address, telephone number and an indication of the Organizer’s business partner that it represents, as well as a detailed description and indication of the reason for the complaint.3.4. The Organizer will address complaints based on the Regulations.3.5. The Organizer’s decision on the complaint is final and binding. The Participant shall be notified of the Organizer’s decisionvia registered mail sent to the address provided in the complaint within 21 days from the date of the complaint’s receipt.3.6. The Promoter is not liable for the Participant’s errors in the promotional procedure, for changing the Participant’s place of stay during the Promotion, or changing other personal data and information that prevent finding the Participant. IV. FINAL PROVISIONS 4.1. The content of these Regulations shall be made available to the Promotion Participants at the Organizer’s office and with the Organizer’s sales representatives.
