GENERAL CONDITIONS FOR THE RETURN OF GOODS PURCHASED BY BUYERS WHO ARE ENTREPRENEURS
Under the terms and conditions set out in these General Terms and Conditions for the Return of Goods (hereinafter referred to as the “GTC”), goods purchased at Master-Sport- Automobiltechnik (MS) Production -Distribution Center Wiesław Rutka with its registered office in Gorlice, ul. 11 listopada 68, 38-300 Gorlice, (hereinafter referred to as “Master Sport”) may be returned regardless of the form of purchase (stationary store, online store) within a period not exceeding 1 (one) year from the date of conclusion of the sales contract, provided that the Buyer who is an entrepreneur (hereinafter referred to as the “Buyer”) submits a written request for the return of goods and obtains prior written or e-mail consent from Master Sport to the return of goods.
Specific goods manufactured to the individual order of the Buyer are not subject to return.
Submitting a request for the return of goods is tantamount to the Buyer’s acceptance of the terms and conditions of the General Terms and Conditions of Sale published on the Master Sport website.
The Buyer has the right to return the goods to Master Sport’s registered office or by shipping the goods at their own expense to the Master Sport registered office address, i.e., ul. 11 listopada 68, 38-300 Gorlice. To return the goods, the Buyer is required to send or present proof of purchase and shipping documents/waybill. Proof of purchase is a VAT invoice (in electronic or paper form).
After final acceptance of the returned goods in accordance with point 9, Master Sport will refund the Buyer the selling price (subject to point 10) reduced by 40% of the value of the goods sold (if the goods were delivered to the Buyer at Master Sport’s expense, the selling price to be refunded is additionally reduced by the cost of transporting the goods). The above-mentioned amount is intended to cover Master Sport’s loss resulting from the reduction in value of the goods, cover the operating costs associated with handling the return of goods, in particular Master Sport’s verification of the quality and compliance of the goods with the original characteristics of the returned goods (including in accordance with point 6), and the costs of legal and accounting support for the return of goods process.
Goods meeting the following criteria are subject to return: a) at the time of return, the goods are in the same technical condition as at the time of their delivery to the Buyer, b) the goods are in their original packaging, c) despite the failure to meet the condition described in point b, unpacked goods, without the original packaging, may also be returned, provided that they do not show signs of wear or only show such signs of use that result from using them in a manner necessary to establish their nature, characteristics and functioning.
Goods that are damaged or show signs of use are not subject to return.
The goods are accepted based on the initial decision of an authorized Master Sport employee after checking that the Buyer has complied with the deadline specified in point 1.
Based on the initial decision regarding return acceptance, a Master Sport employee will assign a unique identification number to the return. The Buyer is obligated to place the assigned identification number in a visible place on each package or pallet containing the returned goods. Failure to mark the package or pallet with the unique returns identification number will result in the package or pallet being returned at the Buyer’s expense.
The final decision on accepting the returned goods is made by an authorized Master Sport employee after a detailed review and examination of the returned goods.
Refund of the sales price for returned goods in the amount indicated in point 5 will only be made in the form of an exchange for other Master Sport goods of the same value. The sales price will not be refunded in cash or by bank transfer.
If, after inspection by Master Sport, it is determined that the goods are not suitable for return, the Buyer is obligated to collect them within 7 days of Master Sport’s request. In such a case, the costs of inspecting the goods described in point 5 will be borne by the Buyer and are payable by the Buyer within 7 days of Master Sport issuing the appropriate invoice. If the Buyer fails to collect the goods within the time period described in the first sentence and fails to pay the costs of inspecting the goods, Master Sport will charge the Buyer storage costs of 1% of the goods’ value for each commenced day of storage. Furthermore, the Buyer’s goods may be secured by Master Sport to cover the costs of inspecting and storing the goods.
Any change to the content of the General Terms and Conditions of Sale will not affect the rights and obligations of the Buyer acquired before the changes entered into force.
The amended General Terms and Conditions will be made available on the website https://www.master-sport.eu and in the stationary store.
The terms and conditions for returning goods are valid from 1 October 2026.
